This Employee Privacy Policy (also, the “Policy”) discloses certain information-handling and privacy practices of  Technicote, Inc. (also referred to herein as “Company,” “we,” “us” or “our”) regarding personal information collected from and about job applicants, employees, contractors employed in our workforce and others similarly situated (collectively, “you” or “Employee(s)”). 
The Policy addresses: 1) What types of information may be collected from or about you, how it may be used and to whom it may be disclosed; 2) What rights and choices you have regarding the use of such information; and 3) How you may contact us to exercise your rights.

INFORMATION WE COLLECT
As used herein, “personal information” or “personal data” means information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Employee or household. Personal information does not include:

  • Publicly available information from government records.
  • Deidentified or aggregated consumer information.
  • Information specified by certain state or federal laws which may thereby be excluded from the scope of “personal information” under some state data privacy laws, such as:
    o    personal health information or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Health Information Technology for Economic and Clinical Health Act (HITECH) or the California Confidentiality of Medical Information Act (CMIA);
    o    personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA), the Driver's Privacy Protection Act of 1994 or the California Financial Information Privacy Act (FIPA).
    Over the past twelve (12) months, we have collected personal information regarding Employees in the following categories:
  • Identifiers, such as real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver's license number, passport number, or other similar identifiers;
    •    Professional or employment-related information, such as current or past employment status, job titles, job history, pay history or performance evaluations; 
    •    Other personal information categories (some of which may overlap with other categories), such as name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, educational background, employment status and history, bank account number, credit card number, debit card number, or other financial, medical or health insurance information
    •    Inferences from other personal information, such as profiles reflecting preferences, characteristics, psychological tendencies, predispositions, behavior, attitudes, intelligence, abilities or aptitudes.

We obtain such categories of personal information from the following categories of sources:

  • Directly from you. For example:
    o    Information you provide in or in support of a job application (such as your name, address, telephone number, e-mail address, previous employer(s), references) or upon acceptance of or during employment.
    o    Comments, questions, and requests you may submit (including through the Company Intranet).
    o    Records and copies of any correspondence (including email addresses, phone numbers and content) between you and us.
    o    Any other information you voluntarily provide.
  • From third party or public sources.  For example, this may include information we request or receive from former employers or references.

USE OF EMPLOYEES’ PERSONAL INFORMATION

We may use or disclose the personal information we collect regarding Employees, including for one or more of the following purposes:

  • To consider and make hiring decisions about prospective Employees.
  • To hire, employ, retain and pay Employees.
  • To communicate with Employees about matters of mutual interest to Employees and Company.
  • To respond to Employee inquiries and requests.
  • To respond to law enforcement requests and as may be required by applicable law, court order, or governmental regulations.
  • As otherwise described to you when collecting your personal information.

For the avoidance of doubt, we do not sell your personal information.

DISCLOSURE OF EMPLOYEES’ PERSONAL INFORMATION

We may disclose your personal information to a third party for a business purpose, subject to the terms of a contract that describes the purpose and requires the recipient to keep that personal information confidential and not use it for any purpose except performing the contract.

We may disclose your personal information to the following categories of third parties: 

  • Service providers (such as our payroll and accounting service providers)
  • Affiliates
  • Other third parties expressly consented to by you
    Disclosures of Personal Information for a Business Purpose
    In the preceding twelve (12) months, we have disclosed for a business purpose the following categories of personal information to third parties:
    •    Identifiers.
    •    Professional or employment-related information
    •    Other personal information categories
    •    Inferences from other personal information

RETENTION OF EMPLOYEES’ PERSONAL INFORMATION

Except as otherwise indicated, we generally retain the personal information of Employees for the period of their employment by us and 05 (five) years thereafter (or in the case of applicants who are not employed by us, for a period of 02 (two) years.

YOUR RIGHTS AND CHOICES

Some state laws provide individuals, including Employees, with specific rights regarding their personal information. This section describes rights you may have (depending on the state in which you reside or are located) and explains how to exercise such rights.

Your rights under certain data protection laws may include the right to: 
i.    request access to your personal information; 
ii.    request corrections to errors in your personal information; 
iii.    request limitations on the use or disclosure of your sensitive personal information (including e.g., geolocation data, biometric data, genetic data, race, ethnicity, sexual or gender orientation, religion, union membership and other protected classifications);
iv.    request erasure of your personal information;
v.    request restriction or object to processing of your personal information, including opting out of automated decision-making; 
vi.    request transfer of your personal information in a suitable format; 
vii.    request identification of the categories of personal information about you we have collected, sold, shared or disclosed in the preceding twelve (12) months;
viii.    request specific pieces of personal information about you collected by us in the preceding twelve (12) months; 
ix.    not face discrimination for exercising such rights; and 
x.    withdraw your consent for or opt out of certain personal information collection.  

Employees may submit requests to exercise their foregoing rights as described below under Exercising Your Rights.

Access to Specific Information and Data Portability
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable request (see Exercising Your Rights), we will disclose to you:

  • The categories of personal information we may have collected about you.
  • The categories of sources for the personal information we may have collected about you.
  • Our business or commercial purpose for collecting any such personal information.
  • The categories of third parties to which we have disclosed such personal information.
  • The specific pieces of personal information we collected about you (in a format easily understandable to the average consumer and, to the extent technically feasible, in a structured, commonly used, machine-readable format).
  • If we disclosed your personal information for a business purpose, a list of such disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Right to Request Correction, Deletion 
You have the right to request that we correct or delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable request (see Exercising Your Rights), we will correct or delete (and direct our service providers to correct or delete) your personal information from our records, unless there is a reason to deny such request, in which case we will so advise you.

Exercising Your Rights
To exercise your access, data portability, deletion and other rights described above, please submit a verifiable request to us by either:

  • Calling us at 1-800-358-4448.

    We will only respond to verifiable requests related to your personal information coming from you, or someone legally authorized to act on your behalf.

Such request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative of that person.
  • Communicate your request with sufficient detail to allow us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the relevant personal information relates to you.

We will only use personal information provided in such a verifiable request to verify the requestor's identity or authority to make the request.

We will confirm receipt of your request within ten (10) business days and provide a substantive response thereto within forty-five (45) calendar days (which we may extend an additional 45 days, if necessary, following notice to you of the reasons for such extension).

Non-Discrimination
We will not discriminate against you for exercising any of your rights described herein. In particular, we will not undertake any adverse employment action against you based upon your efforts to exercise your rights under this Policy.


CHANGES TO THIS POLICY 
We reserve the right to amend this Employee Privacy Policy, from time to time, as changes in the law and our information-handling practices may, in our sole discretion, warrant. When we make material changes to this Policy, we will make the updated Policy available to Employees on the Company Intranet or through other appropriate means and update the “Last Revised Date” shown herein.
